What the meeting considers
A manifestation determination review generally asks whether the conduct was caused by or had a direct and substantial relationship to the disability, or whether the conduct was the direct result of failure to implement the IEP.
Prepare with documents
Gather the IEP, behavior plan, discipline records, incident report, emails, attendance, assessment reports, medical or clinical information you want considered, and prior behavior data.
Key questions
Ask what happened, what evidence supports the account, whether the IEP was implemented, whether the behavior is related to known disability needs, and whether additional assessment or behavior support is needed.
Implementation issues
If services, accommodations, supervision, behavior supports, or safety plans were not followed, document the specific parts that were not implemented and how that may have affected the incident.
After the meeting
Ask for the written decision, notes, and any proposed changes. If behavior support is needed, ask about an FBA, BIP review, placement review, or additional services.
Stay organized
Discipline issues can move quickly. Keep communication in writing and maintain a clear timeline of events.
